The Agreement (Contract) Between You and Us 

When you place an order to purchase products direct from dottyaboutpaper.co.uk, you are offering to purchase goods subject to these terms and conditions. After you place your order, you should receive an e-mail from us confirming that we have received your order, however, this email does not represent acceptance by us of your order, only confirmation that we have received your offer. Once we're about to send out your order, we debit your payment card with the total cost of the items we're sending you.

The contract between us is only created once we send you the products you ordered, and not before. It means we have accepted your offer and fully communicated this to you.

In the event that we take payment for and ship only part of your order, only that part of your order that we have taken payment for and dispatched to you will form that contract. In processing your order, we will rely on the information you have provided in the order form in order to process it, take payment and deliver it. Please therefore ensure that the details provided on the order form are accurate as we will not be obliged to accept an order, nor will we be liable for any mistakes, unless all details requested on the order form have been entered correctly.

Though we check our system frequently to try and avoid errors, things can occasionally go wrong with the ordering process. If we make a mistake we will do our best to put things right as quickly as we can, with as little inconvenience to you as possible. We do however reserve the right to cancel any order for any reason at any time prior to dispatch, for example (but not limited to) where there is an obvious material mistake in the price or product information.

Cancellation of an Order

 You can cancel your order under 3 different circumstances:

1. You may cancel your order before we have commenced any work on your order

• (a full refund will be given in this instance)

2. There is a 30 Calendar day cooling off period for certain items ordered online - this excludes any personalised items or products made to your specification.

• If your order includes personalised stationery and the creation/setting of any artwork has already been started, a charge will apply. This charge will depend upon the items ordered (for example, the artwork orders of service take a lot of time to set).

3. Faulty goods

• You should inspect any goods as soon as you can after delivery and notify us if you consider they are defective as soon as possible. If the goods is incorrect, faulty or defective you are entitled to either:

• During the first 30 days after the delivery date

   • ask us to reimburse the price paid for the relevant goods via the payment method used to purchase the goods.

• During the first 6 months after the delivery date: ask us to repair the goods at our own expense

   • ask us to supply replacement goods free of charge.

   • If you are sending something back that's faulty or incorrect due to our error, we will refund the return postage costs, but not in other circumstances.

• You have statutory rights against us and any warranty applicable to an item is additional to those rights. You can also obtain free legal advice on your statutory rights in relation to faulty or misdescribed goods from Trading Standards (via Citizens Advice Consumer Service on 03454 040506) or your local Citizens Advice Bureau. • You are also entitled to settle any dispute through the online resolution platform.

Pricing

The prices for direct sale to individual consumers for an order will be those shown on this website at the date and time that the order is received. Prices shown on this site include VAT, where and to the extent that VAT is required to be applied to the product under UK VAT law. Whilst we will not normally increase the price of product between order and dispatch, we reserve the right, by giving notice to you at any time before delivery, to increase the price of the goods to reflect any increase in the cost to us which is due to any factor beyond our control (such as, without limitation, any foreign exchange fluctuation, significant increase in the costs of labour, materials or other costs of manufacture).

In the unlikely event of there being such an increase in the price of the goods, we will contact you and you may cancel your order if you wish. 

Availability

We update our availability information regularly but occasionally a product may run out between updates.

We do our best to dispatch your products within the lead time shown on the product page when you order. If this is not possible, your order will be sent out as soon as the goods become available. If we can't supply your order within 30 days, we will notify you and we will cancel the order. The dispatch and delivery times shown are approximate and delays can sometimes occur. Delivery times are based on working days (Monday - Friday, excluding Public Holidays).

We will email you as soon as your order is ready to be dispatched.

Payment 

All product prices and delivery charges are shown in UK pounds sterling. When we provide any goods to you under these terms and conditions, payment must be received before any goods are dispatched. We accept payment by Visa, Mastercard, Maestro, Paypal Apple Pay, Google Pay and Revolut Pay.

 

On rare occasions when we go to pick your item(s) we may find that it is damaged or we do not have the item in stock. In these circumstances, we will have charged your credit / debit card expecting to dispatch your item(s). Therefore, we will refund the order and re-order the item(s) on your behalf. Your statement will show a charge and refund in short succession. We will then charge your card when the item(s) comes back into stock and we are ready to dispatch it.

If your order is spilt into multiple deliveries, we add the delivery charge to the first item(s) we send you. You are only charged for each additional item in your order when it is sent.

Delivery 

The goods will be delivered to you, the buyer, or to your nominated recipient, to the name and address provided by you on the order form. Title to the goods will pass to you on payment in full of the price of the goods. The risk of the goods shall pass to you upon dispatch to this address. Any time or date for delivery by us is provided to you in good faith but is an estimate only and no liability will be accepted for any loss whatsoever suffered or caused through late delivery or non-delivery.

Please examine your goods at the time they are delivered - any damaged or defective goods, or incorrect or incomplete orders, must be reported to us with 48 hours in accordance with our Returns Policy.

If we have not been notified within this period then the goods will be deemed to have been delivered undamaged, without defect and in accordance with the dispatch. Notwithstanding these contractual conditions, we are proud of the quality of our products and want you to be happy with the products you have purchased from us. In the event of any dissatisfaction, please contact us and we will do all that we can do to put things right.

Customer Artwork

A proof will be sent to you via email for personalised stationery orders. Please check all proofs thoroughly - we cannot be held responsible for errors found once a proof has been agreed.

To enable us to send you a proof, you will need to provide us with a confirmation email address. You will need to approve the proof or make any necessary changes to it before we can print and dispatch your order. When viewing your PDF proof on a mobile device/tablet, it may not show correctly. A PC/laptop should be used wherever possible. Colours can vary greatly from one monitor to another and so are not necessarily representative of the printed products. 

All designs, artwork, and proofs are owned by The Card Gallery (UK) Ltd and cannot be reproduced by any other individual or company without our consent.

Electronic Communications 

When you visit our web site or send e-mails to us, you are communicating with us electronically. We communicate with you by e-mail or by posting notices on the website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

Events Beyond Our Reasonable Control 

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.

Your Privacy When You Shop Online With Us

We want you to be able to shop with confidence on our site, which is why we take the privacy of your personal information very seriously.

When you shop with us, you give us certain personal details, such as your name, email address and payment address. We hold such information securely using SSL encryption software. SSL stands for Secure Sockets Layer which is the industry standard security technology for keeping data private during online transactions. This means your personal information cannot be read by anyone who should not see it.

We do not require you to create an account to shop with us. New customers have the option to create an account by adding a password after they have checked out.

Limitation Of Liability

If either of us fails to comply with these Terms, neither of us shall be responsible for any losses that the other suffers as a result, except for those losses which are a foreseeable consequence of the failure to comply with these Terms.

Nothing in these Terms shall exclude or limit our liability for:

1. death or personal injury resulting from our negligence;

2. death, personal injury or damage to property caused by a defective Product;

3. fraud or fraudulent misrepresentation;

4. breach of the term implied by section 12 of the Sale of Goods Act 1979;

5. breach of the terms implied by sections 9, 10 and 11 of the Consumer Rights Act 2015 (that Products we sell will: (a) correspond with any description we provide; (b) be fit for purpose and (c) be of satisfactory quality);

6. breach of the terms implied by section 2 of the Sale of Goods and Services Act 1982 (that you will have quiet possession of Products you purchase and that Products you purchase will be free from encumbrances).

Subject to the above, our total liability to you for all and any damages, losses, and causes of action shall not exceed the total of the amount paid by you, if any, for accessing the Website, purchasing the Products and/or using the Services provided via the Website and any foreseeable consequential loss or damage you may incur as set out above.

Severability

If any part of these terms and conditions is found to be unenforceable as a matter of law, the enforceability of any other part of these terms and conditions will not be affected.

If any invalid, unenforceable or illegal provision of these terms would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable.

Governing Law

These terms and conditions and any contract between us are governed by English Law and we both agree to the non-exclusive jurisdiction of the English Courts.

Statutory Rights

Nothing in these conditions will reduce your statutory rights relating to faulty or misdescribed goods. For further information about your statutory rights contact your local authority Trading Standards department or Citizens Advice Bureau.
